Right to work

Any workers that are engaged by us will need to have documentation to show that they have the right to work in the UK.


If you operate a Personal Service Company (PSC) then you will need to be mindful of the IR35 legislation and how it affects your running of the business and any remuneration you receive.


Workers engaged under our Contractor Payroll service can receive legitimate business expenses if they’re not under SDC (*see below) or are multi-site workers. PSC contractors can claim a wider variety of expenses.

False self employment

Having the correct right to work documentation is essential, whether this is your passport, a work visa or any other type of allowance for working in the UK. Getting this wrong can cost us, as the employer, thousands of pounds!


IR35 was introduced in 2001 to deter workers that would otherwise be ‘employees’, to work as a self- employed contractor for the client. This allowed the client to save on Employers’ National Insurance. If you are ‘inside IR35’ then it is risky to be paid in dividends, and any income should be employment income. If an expense is necessary and is in the course of your work, then it is a legitimate business expense. However, since the rule changes in 2016, only workers not under the supervision, direction or control of the client, or those travelling to several work sites in a single day, can claim expenses.


The Onshore Intermediaries (False Self-employment) legislation came into effect in 2014 and states that PAYE, including Employers’ NI, be applied to your payments unless it is shown that you are genuinely self-employed. In order to prove self-employment, you must not be subject to any direction, supervision or control for the assignment you are working on.
