Following the Taylor Review on Modern Working Practices, the Governments proposed changes to employment law came into effect on the 6th April 2020
Encompassed within each Regulation are changes designed to improve the treatment of the UKs flexible workforce. Below is a summary of each legislation, highlighting what that change means for recruitment.
New Legislation
The Agency Workers (Amendment) Regulations 2019:
- Repeal of the Swedish Derogation (or, as it is also known, Pay Between Assignments)
The Employment Rights (Employment Particulars and Paid Annual Leave) (Amendment) Regulations 2018:
- Day one right to a written statement of employment particulars for all employees
- Amendment to holiday pay reference period, from 12 weeks to 52 weeks
The Employments Rights (Miscellaneous Amendments) Regulations 2019:
- Increase the maximum financial penalty for breach of workers rights from £5,000 to £20,000
- Right to a written statement is extended from just employees to all workers
The Conduct of Employment Agencies and Employment Businesses (Amendment) Regulations 2019:
- Requirement to provide workers with a “Key Information Document” to improve pay transparency.
